Abstract
[English] According to Robin Osborne, OA (gold) mandates misrepresent research publishing by treating articles as products, rather than as parts of a process, involving both thinking and teaching. In such a perspective, Kant's ideas on authors' rights might be worth scrutinizing because they do not depend on a a theory of intellectual property. Therefore, they allows us to see research publishing as part of the process of the public use of reason and to take into account both the concern of the public to access them and the authors' interest to come of age by mastering their relationship with the public. [italiano]Robin Osborne critica la versione "gold" dell'accesso aperto per la sua rappresentazione - riduttiva - della pubblicazione accademica come prodotto e non come fase di un processo che comprende, senza soluzione di continuità, l'insegnamento e la ricerca. In questa prospettiva, una teoria del diritto d'autore non fondata sulla proprietà intellettuale - quale quella di Kant - può rendere giustizia alla pubblicazione scientifica come parte di un processo, all'interesse del pubblico ad accedervi e a quello dell'autore a controllare la mediazione del suo rapporto col pubblico da maggiorenne.
